Privacy Policy

Privacy is a fundamental right, and at LetsVenture Technologies Private Limited (LV/Us/We/Our), it is treated as such. As part of your use of the Platform, We collect and process user data. We acknowledge that you (You or Your) care how information about You is used and shared and We truly appreciate Your trust in Us to do that carefully and sensibly. This document describes the privacy policy of (Privacy Policy) that applies to the use of https://scalix.co. (Product) and any Services where this Privacy Policy is referenced, regardless of how You access or use Our Services (including through mobile devices). The Privacy Policy shall be read in conjunction with the terms of use (accessible at https://scalix.co/terms-of-use (Terms of Use). Any term which is undefined herein, shall be construed to have the same meaning as in the Terms of Use.  

 

This Privacy Policy is a legally binding document between You and Us. The terms of this Privacy Policy will be effective upon the access and/or use of the Product in any manner. Please note that Your data may be collected by Our affiliates outside of the Product through in-person meetings, participation in conferences and other forums, including but not limited to, through forums, responses to promotional and other materials. In order to expand Our prospects and range, We may have built in data technologies into Our Product which may use additional sources to collect data. Please note that the data collected by Us is secured to the best of Our ability.

 

As explained in Our Terms of Use, We allow users to add content to the Services in a number of different ways, including via direct messages and in smaller and larger communities. Some of these spaces are public, and if You share content within them, that content may be accessed by many people, including people You do not know.

 

Please read this Privacy Policy document along with the Terms of Use carefully before You access Our Product to fully understand what We do. If You do not agree or fully understand the Terms of Use and/or Our Privacy Policy, please do not use the Product and/or avail Our Services. You hereby provide Your unconditional consent or agreements to LV as provided under Section 43A and Section 72A of Information Technology Act, 2000.

 

  1. PERSONAL INFORMATION

While accessing and/or using Our Product/Services, We may ask You to provide Us with certain information which may be generic or personally identifiable information that can be used to contact or identify You, which shall include the various types of data as classified hereunder (Personal Information). Wherever possible, we may indicate which fields are required and which fields are optional. We use Your Personal Information for the conduct of legitimate interests in order to provide better connection within the founder community through collaboration. Please note by using/accessing this Product/Services, You consent to the terms of disclosure of information, including Personal Information as per the Privacy Policy. We strongly recommend You to prevent sharing Your Sensitive Personal Information including, inter alia, Your financial information such as bank account or credit card or debit card or other payment instrument details (except to Our authorised third party Payment Processors to the extent necessary for subscription) and medical data, while using the features of the Product, including while interacting with other users of the Product.

  1. LV does not take any responsibility for the genuineness or veracity of the information provided by any third party or other users of the Product/Services. While the Product endeavours to pre-screen and qualify users after an involved exercise, such screening or qualification is not error-free, exhaustive or warranted by it. 

 

  1. Personal Information may include, but is not limited to Your name, Your address, Your telephone number, Your email address or contact information, Your date of birth or Your gender. We use Your information to carry out Our Services, process payments, communicate with You, update Our records and generally maintain Your transaction history with Us. We also use this information to improve the Product, prevent or detect fraud or abuses and enable third parties to carry out technical, logistical or other functions on Our behalf. To give You a greater insight into the type of Personal Information We collect, We have tried to classify the Personal Information We gather. Please note that this is not an inclusive list.

 

  1. Contact Information:  We receive and store any information You enter on the Product or give Us in any other manner. You can choose not to provide certain information based on Your preferences. Your general contact information, including Your name, photograph, address, telephone number, date of birth, gender, e-mail address, social media profiles, contacts, etc. maybe some of the information We collect.

 

  1. Technical Information: We receive and store certain types of information whenever You interact with Us. This can be through any means, via e-mails, a visit to the Product or via telephonic communication, while completing surveys, feedback, cookies placed on Your device/browser, etc. We may also receive/store information about Your location, address, browser type, browser version, the pages of Our Product that You visit, the time and date of Your visit, the time spent on those pages, Your web requests, referring/ exit pages and URLs, number of clicks, domain names, landing pages, click paths, feature usage and other such information and statistics including but not limited to the internet protocol address of Your device and Your transaction history. We may use this information for internal analysis and to provide You with location based Services or for Services which are more personalized.

 

  1. Content and Actions : We receive and store any content that You add, upload, post, share, display, or stream to/through Our Product and/or while availing Our Services. For example, You may write messages (including drafts), create custom emojis, or upload and share posts, files, text, links, GIFs, emoji, photos, videos, documents, or other media through the Services. We collect information about Your use of and activities on the Services. This includes information on the other users You connect with, the group chats or communities You join, content moderation decisions You make, and other related actions.

  1. Sensitive Personal Information: shall mean and include any items that are enumerated in Rule 3 of Information Technology (Reasonable Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, particularly Your passwords.

Third-Party Data: By using or continuing to use the Product, You agree to Our use of Your information (including Sensitive Personal Information) in accordance with this Privacy Policy, as may be amended from time to time by LV in its sole discretion. You also agree and consent to Us collecting, storing, processing, transferring and sharing information (including Personal Information) related to You with third parties or service providers for the purposes as set out in this Privacy Policy subject to such third parties or service providers having the same level of data protection that We adhere to.
  2. Other Data: Depending on Your engagement with Us, We may request You to provide Us with applicable information that We may require in order to render Our Service from time to time.

 

  1. USAGE OF PERSONAL INFORMATION

 

  1. We use the information we collect to:
  1. Deliver, protect and improve the Services and Your overall user experience.
  2. To link or combine user information with other Personal Information.
  3. To compare and verify information for accuracy and update our records.
  4. For moderating the content available on the Product.
  5. To meet our commitments to the users and provide more personalised Product and Services.
  6. Email, text, message, or otherwise contact You with information and updates about Us and the Services.
  7. To respond to Your comments and questions and provide customer service.
  8. To send You information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.
  9. to keep our Services secure, to prevent misuse, and to enforce our Terms of Use and other policies against users who violate them.
  10. Analyse how You use the Services with tools such as Google Analytics and other tools to help us understand traffic patterns and improve the Services.
  11. To comply with our legal obligations and to report on our Product’s performances.

 

  1. We also collect, use and share aggregated data such as statistical or demographic data for internal purposes. We may be required to share the aforesaid information with government authorities and agencies for the purposes of verification of identity or for prevention, detection or investigation, including cyber incidents, prosecution and punishment of offences. You agree and consent for LV to disclose Your information, if so required, under applicable law.

 

  1. You acknowledge and agree that We use this information to provide the Services We offer. In order to do so, We may display and share certain information on our Product for public viewing. 

 

  1. We shall not sell Your Personal Information for Our monetary gain in any manner. You acknowledge and agree that We use these information to deliver a better and personalized user experience as mentioned in this Privacy Policy.

However, We do not collect any special category of Personal Information including details about Your race, religion, ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union memberships, information nor do We collect any information about any criminal offences or convictions. Please note that by not providing Us with complete information or by restricting the information to be displayed, You might hamper Your access to the Product and Our Services.

 

  1. AUTHORIZED THIRD PARTY ACTIVITIES

Links to third-party websites or any third party electronic communication service may be provided on the Product which are operated by third parties and are not controlled by, or affiliated to, or associated with Us. LV provides these links to You as a convenience only and the inclusion of any link does not imply any endorsement of the linked website, the website's provider or the information on the website by LV. Your interaction with any such linked website is entirely at Your own risk. LV is not a party to any transaction between You and a linked website. LV does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such third party websites, nor does LV control or guarantee the accuracy, integrity, or quality of the information, data, text, software, music, sound, photographs, graphics, videos, messages or other materials available on such third party websites. LV is not responsible for any form of transmission, whatsoever, received by You from any third party websites. Your use of a linked website and the information provided by You to such third party websites is subject to the terms and conditions and privacy policies of that site. It is recommended that You review the privacy policy of such third party websites prior to using such websites.

We may share Personal Information, including stored cookies (detailed in Paragraph 4) with entities that provide services to Us, including companies that provide web analytics, storage, email distribution and other services. The use of Personal Information by such companies is limited to the purpose of rendering the contracted services. 

 

  1. Unaffiliated third parties are providers of avenues, content, functionality and services for Our web and social media sites. We do not control what and how these and other third parties collect Personal Information or how they use it. We do not control and are not responsible for the business practices of any third parties which employ sophisticated technologies such as cookies, web beacons and new and innovative tools, techniques and practices to collect, receive, process, buy and sell personal information. Please note here that certain of their activities can potentially be managed by users themselves, as for instance, through Internet browser and handheld app controls.

  1. When You use the Product or avail the Services, We try to make that experience simple and meaningful. Alternatively, if You believe that any of Your Personal Information held by Us is inaccurate, You may write to Us at help@scalix.co. It is Your responsibility to ensure that any information You provide to Us remains accurate and updated.

  1. We will only retain Your Personal Information for as long as necessary to fulfil the purposes We collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for Personal Information, We consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of Your Personal Information, the purposes for which We process Your Personal Information and whether We can achieve those purposes through other means, and the applicable legal requirements.

 

  1. In some circumstances, We may anonymize Your Personal Information (so that it can no longer be associated with You) for research or statistical purposes in which case We may use this information indefinitely without further notice to You.

 

  1. RIGHT TO UNSUBSCRIBE

 

  1. You always have the option to not provide information by choosing not to use the Product or a particular feature thereof (where such feature is available for opt-out). We may automatically use our available technology to retain Your preferences.

 

  1. When You update information, We usually keep a copy of the previous version for Our records. If You do not want to receive updates from Us, please update Your preferences or write to Us at help@scalix.co. However, opting out of updates still governs Your use of the Product under the Terms of Use and Privacy Policy.

 

  1. PERSONS ALLOWED TO USE PRODUCT

 

Use of Product is available only to users who can form a legally binding contract under the Indian Contract Act, 1872. If You are a minor i.e. under the age of 18 years, You may use the Product only with the involvement of a parent or guardian. We do not knowingly collect or store Personal Information of children unless permitted by law. 

 

  1. INDEMNITY

 

You agree to indemnify and hold LV harmless from:(i) any actions, claims, demands, suits, damages, losses, penalties, interest and other charges and expenses (including legal fees and other dispute resolution costs) made by any third party due to or arising out of any violation of the terms of this Privacy Policy; or (ii)any acts or deeds, including for any non-compliance or violation, of any applicable law, rules, regulations on Your part; or (iii) for fraud committed by You.

 

  1. NO IMPLIED WAIVER

 

The rights and remedies available under this Privacy Policy may be exercised as often as necessary and are cumulative and not exclusive of rights or remedies provided by law. It may be waived only in writing. Delay in exercising or non-exercise of any such right or remedy does not constitute a waiver of that right or remedy, or any other right or remedy.

 

  1. FOREIGN JURISDICTION

 

LV makes no representation that the content contained in or the Product itself is appropriate or to be used or accessed outside of the Republic of India. If You use or access the Product from outside the Republic of India, You do so at Your own risk and are responsible for compliance with the laws of such jurisdiction.

 

  1. MISCELLANEOUS

 

The provisions of Clauses 11 (Governing Law), 12 (Dispute Resolution and Binding Arbitration) and 13.2 (Severability) of the Terms of Use shall mutatis mutandis apply to this Privacy Policy and are deemed to be incorporated here by reference.

 

  1. GRIEVANCES

 

LV strives to redress the concerns of users expeditiously. An aggrieved donor may report his/her concern to the grievance officer who shall redress the grievances within one month from date of receipt of such grievance.
